EPR in Spain 2026: Packaging, WEEE & Batteries

Short answer: if you place packaged goods on the Spanish market, you must register in MITECO's Registro de Productores de Producto (packaging section). Producers established in another EU country or outside the EU must appoint a representante autorizado in Spain — otherwise the first Spanish distributor or, for online sales, the marketplace steps in as producer. There is no registration de-minimis. Electrical equipment and batteries are registered separately with the industry ministry (RII-AEE / RII-PYA).

Spain's EPR registers at a glance
Spain uses national registers: one at the environment ministry for packaging and the industry ministry's registers for electrical equipment and batteries.

What changed in 2026
The EU Packaging and Packaging Waste Regulation (PPWR, Regulation (EU) 2025/40) has applied directly in Spain and every other member state since 12 August 2026. It entered into force on 11 February 2025 and replaced most of the old Packaging Directive 94/62/EC, which was generally repealed on 12 August 2026 (some provisions continue). - Authorised representative (Art. 45): producers that sell packaged products directly to end users in another member state — whether established in the EU or outside it — must appoint an authorised representative in each member state where they first make packaging available, other than their own. For other non-EU producers, member states may require one.
- Pragmatic enforcement: the European Commission has asked member states to enforce the authorised-representative duty in a "constructive and pragmatic" way while an exemption is being negotiated.
- Penalties: member states must lay down their PPWR penalty rules by 12 February 2027 (Art. 68).
- Fees and labels: EU-harmonised fee modulation by recyclability grade is expected from around 2028–2030; harmonised packaging labelling applies from 12 August 2028 or 24 months after the implementing acts, which had not been adopted as of September 2026.
Proposal – not yet law EU omnibus and the AR exemption. The Environmental Omnibus (COM(2025) 982, 10 December 2025) proposes suspending the authorised-representative duty for EU-established producers. The European Parliament adopted its position on 20 October 2026 (exemption for EU micro and small enterprises until 2035, as reported). The Council agreed its negotiating position on 21 October 2026: EU-established producers placing less than 1 tonne of packaging per year in another member state would not need an authorised representative there, until 2032. Trilogue negotiations follow. This is not law yet, and it does not cover sellers established outside the EU.
Spain: PPWR and Royal Decree 1055/2022
According to a MITECO clarification note, the PPWR prevails over national law, and Royal Decree 1055/2022 on packaging continues to apply where it is compatible with the PPWR. This means the national register, the representative duty and the reporting obligations continue to apply as far as they are compatible with the PPWR.

Packaging obligations in Spain
A packaging producer in Spain ("productor de producto") is a business that packs products or imports or acquires packaged products and places them on the Spanish market. Under the PPWR, sellers shipping directly to Spanish end users are producers in Spain for that packaging.
- Appoint a representante autorizado if your company is established outside Spain — in another EU member state or in a third country.
- Register in MITECO's Registro de Productores de Producto (packaging section), directly or through your representative. There is no minimum quantity for registration.
- Choose how you meet your EPR obligations, usually by joining a collective EPR system. Joining a system does not replace your own registration.
- Declare your packaging. Producers placing less than 15 tonnes on the market can use a simplified declaration; above that, the standard declaration applies. Reporting periods are published on the ministry's website.
- Show your number. The registration number should appear on invoices or commercial documents, and Amazon.es asks for it.

WEEE obligations in Spain (RII-AEE)
Producers of electrical and electronic equipment register in the RII-AEE, the industry ministry's integrated industrial register for EEE. Royal Decree 993/2022 adds a customs control: import declarations for EEE must match the data in the register. Make sure your register entry and your import declarations use the same data.
Battery obligations in Spain (RII-PYA)
Battery producers register in the RII-PYA, the industry ministry's register for batteries and accumulators. The same RD 993/2022 customs control applies: import declarations must match register data. Proposal – not yet law A new batteries royal decree is in preparation (consultation closed 3 September 2026).
On top of national rules, the EU Battery Regulation (EU) 2023/1542 has applied its extended producer responsibility regime since 18 August 2025. Further steps are scheduled from 18 February 2027: a QR code on all batteries, removability and replaceability rules, and a battery passport for EV, LMT and industrial batteries above 2 kWh. Battery due-diligence obligations have been postponed to 18 August 2027 (Regulation (EU) 2025/1561).
Proposal – not yet law The EU omnibus would also suspend the authorised-representative duty for batteries (European Parliament vote on 20 October 2026; Council position pending).
Representante autorizado: who needs one in Spain
A representante autorizado is a person or company in Spain appointed by a foreign producer to fulfil its EPR obligations in Spain. Spain requires one for producers established in another EU member state and for producers established outside the EU.
If no representative is appointed, the obligations do not disappear: the first distributor in Spain is liable on a subsidiary basis, and for online sales the platform acts as producer on a subsidiary basis. Amazon.es, for example, charges sellers for its Pay on Behalf fallback — see below.

Amazon.es: registration number or Pay on Behalf
Sellers on Amazon.es who are not established in Spain must submit their Spanish packaging registration number. Otherwise Amazon enrols them in its paid "Pay on Behalf" service, and listings may be deactivated.
Pay on Behalf is a fallback: it does not replace the seller's own registration or legal responsibility as producer. A seller who also ships through its own shop or other marketplaces still needs its own registration and representative.
Marketplaces check EPR numbers. In its notice of 25 March 2026, Amazon announced packaging EPR compliance checks across the EU from 12 August 2026 and named Spain among the countries concerned; Amazon "may need to stop selling your non-compliant products". eBay requires packaging EPR numbers from 12 August 2026 for each country in which the seller is a producer, and listings may be hidden from buyers in that country. Penalties in Spain (Ley 7/2022)
Spain's waste law, Ley 7/2022, groups offences into three tiers. Which tier applies depends on the offence.

For EEE and batteries, mismatches between import declarations and register data can also lead to problems at customs under RD 993/2022. At EU level, member states must have PPWR penalty rules in place by 12 February 2027.
FAQ: EPR in Spain
Where do I register packaging in Spain?
Packaging producers register in the packaging section of the Registro de Productores de Producto run by the Spanish Ministry for the Ecological Transition (MITECO). The registration number should appear on invoices or other commercial documents. Joining a collective EPR system does not replace your own registration.
Do EU sellers also need a representante autorizado in Spain?
