Short answer: producers who place packaging, batteries or electrical equipment on the Danish market register with Dansk Producentansvar (DPA), which keeps Denmark's producer register; packaging and batteries were added to it in 2025. According to DPA, companies established in another EU country need a Danish authorized representative, while companies established outside the EU may register directly โ€“ except for batteries, where a representative is required. Danish supplementary rules to the EU Packaging Regulation (BEK no. 851 of 28 September 2026) are in force since 15 October 2026.

What changed in 2025 and 2026

Denmark has rebuilt its producer responsibility in two steps. In 2025, packaging and batteries were added to the producer register kept by Dansk Producentansvar. In 2026, the EU Packaging and Packaging Waste Regulation (PPWR, Regulation (EU) 2025/40) started to apply on 12 August, and Denmark adopted supplementary national rules.

  • BEK 851/2026: executive order (bekendtgรธrelse) no. 851 of 28 September 2026 sets out Danish supplementary rules to the PPWR. It entered into force on 15 October 2026.
  • PPWR representative duty: under Art. 45 PPWR, producers who sell packaged products directly to end users in another member state must appoint an authorized representative in each member state where they first make packaging available, other than their own.
  • Pragmatic enforcement: the European Commission has asked member states to enforce the representative duty "in a constructive and pragmatic" way while an exemption is negotiated.
  • Marketplaces: Amazon's global notice of 25 March 2026 names Denmark for cross-border sellers in its EU packaging EPR announcement.

Proposal โ€“ not yet law The EU Environmental Omnibus (COM(2025) 982) proposes suspending the representative duty for EU-established producers. The Council position of 21 October 2026 would exempt EU-established producers placing under 1 tonne of packaging per year in another member state until 2032; the European Parliament adopted its position on 20 October 2026. Trilogue follows. It does not cover non-EU sellers. More: PPWR 2026 update.

Packaging obligations in Denmark

A packaging producer is the business that first makes packaging available on the Danish market. A seller established elsewhere who ships packaged goods directly to Danish end users is a distance seller under the PPWR and the producer of that packaging โ€“ product packaging, shipping cartons and filling material alike.

  1. Map your Danish packaging. List every packaging type that reaches Danish customers, by material and weight.
  2. Check where you are established. EU-established companies need a Danish authorized representative; non-EU companies may register directly with DPA (according to DPA's FAQ).
  3. Register with Dansk Producentansvar. Registration runs through DPA's producer register, directly or via your representative.
  4. Apply the new Danish rules. Take BEK 851/2026 (in force since 15 October 2026) into account for your set-up and reporting.
  5. Keep your data ready for reporting. Reporting content and intervals depend on your products; we confirm them in the free check.

WEEE obligations (electrical and electronic equipment)

Producers of electrical and electronic equipment also deal with DPA's producer register. Our verified sources cover DPA's general representative rule โ€“ EU companies need a Danish authorized representative, non-EU companies may register directly โ€“ but not the WEEE-specific details such as categories, financing and reporting. We confirm these for your products as part of the free obligation check rather than publishing unverified details.

Battery obligations

Batteries were added to the DPA register in 2025. Batteries are the exception to DPA's direct-registration rule: according to DPA, a representative is required for batteries, also for companies established outside the EU.

  • EU level: the EPR regime of the Battery Regulation (EU) 2023/1542 applies since 18 August 2025.
  • From 18 February 2027 (reported): QR code on all batteries, removability and replaceability rules, and a battery passport for EV, LMT and industrial batteries above 2 kWh.
  • 18 August 2027 (reported): due-diligence obligations, postponed by Regulation (EU) 2025/1561.
  • Proposal โ€“ not yet law The EU Omnibus would also suspend the batteries representative duty; Parliament voted on 20 October 2026, the Council position is pending.

Authorized representative in Denmark

An authorized representative is a business established in Denmark that fulfils the producer's obligations there on behalf of a company established elsewhere. According to DPA's FAQ, the Danish rules depend on where you are established and what you sell:
