Authorized Representative in Spain 2026:
The Representante Autorizado
Spain asks every packaging producer established abroad โ in another EU member state or outside the EU โ to appoint a representative in Spain. Without one, the duties do not disappear: they shift to your Spanish distributor or to the marketplace.

Short answer: if your company is not established in Spain and you place packaged products on the Spanish market, you have to appoint a representante autorizado โ a person or company in Spain that fulfils your producer obligations there. According to the environment ministry MITECO, the representative enters you in the national producer register and reports your data. There is no minimum quantity for registration.
Authorized representative in Spain at a glance
- Packaging
- Mandatory representante autorizado for producers established in another EU member state or in a third country (MITECO).
- What it does

- Minimum quantity

- Electrical equipment and batteries
- Separate registers at the industry ministry (RII-AEE, RII-PYA). Batteries: EU representative rule for distance sellers. Electrical equipment: check case by case.

- Exemption?
- Proposal โ not yet law EU proposal for small EU-established packaging producers only.
Do I need a representante autorizado in Spain?
For packaging, the Spanish rule is broader than the EU rule: it depends on where your company is established, not on whether you sell directly to end users.
| Your situation | What Spain requires |
|---|---|
| Company established in Spain | No representative. You register yourself. |
| Company in another EU member state placing packaged products on the Spanish market | Representante autorizado in Spain. |
| Company outside the EU (for example US, UK, China) placing packaged products on the Spanish market | Representante autorizado in Spain. The proposed EU exemption would not cover you. |
| You sell on Amazon.es and are not established in Spain | Amazon asks for your Spanish packaging registration number. Without it you are enrolled in the paid Pay on Behalf service, and listings may be deactivated. |
| You sell electrical equipment or batteries into Spain | Separate registers (RII-AEE, RII-PYA); import declarations must match the register data. For batteries, the EU representative rule for distance sellers applies. |

Why Spain asks for a representative
Spain wants a responsible party on Spanish territory for every producer. A producer established in Spain registers itself in the Registro de Productores de Producto. A producer established abroad cannot be reached in the same way โ so it appoints a representative in Spain, and that representative registers the producer and reports for it.
The legal frame is in transition. Since 12 August 2026 the EU Packaging Regulation (PPWR) prevails, and Spain's Royal Decree 1055/2022 continues to apply where it is compatible with it. A new packaging royal decree is being drafted. Proposal โ not yet law
What happens without a representative
The obligations do not disappear โ they move to someone else in the chain. If a foreign producer has not appointed a representative, the first distributor in Spain is liable on a subsidiary basis. For online sales, the platform acts as producer on a subsidiary basis.
In practice this means your Spanish trading partner or your marketplace carries a duty that is yours โ and has every reason to ask for your registration number before doing business with you.
Fines under Spain's waste law (Ley 7/2022) are graded: minor offences up to โฌ2,000, serious offences from โฌ2,001 to โฌ100,000, and very serious offences from โฌ100,001 up to โฌ3.5 million.
Amazon.es: registration number or Pay on Behalf
Sellers on Amazon.es that are not established in Spain have to submit their Spanish packaging registration number. Otherwise Amazon enrols them in its paid Pay on Behalf service, and listings may be deactivated.
Pay on Behalf is a fallback. It does not replace the seller's own registration or its legal responsibility as producer. A seller that also ships through its own shop or other marketplaces still needs its own registration and representative.
Electrical equipment and batteries
Electrical equipment and batteries are registered separately, at the industry ministry: RII-AEE for electrical and electronic equipment, RII-PYA for batteries. Under Royal Decree 993/2022, customs checks imports against these registers: the import declaration has to match the register data.
For batteries, the EU Battery Regulation requires distance sellers from another member state or a third country to appoint a representative in each member state where they sell (Art. 56(3), according to law-firm analysis). For electrical equipment we have not yet verified the Spanish representative rule against an official source โ we check it for your case. A new batteries royal decree is in preparation. Would the proposed EU exemption help?
Only small producers established in the EU, only for packaging โ and only once it is law. How Spain would apply it next to its own national rule is open.
Proposal โ not yet law EU exemption for small EU-established producers. The European Commission's Environmental Omnibus of 10 December 2025 proposes suspending the authorized-representative duty for producers established in the EU. The European Parliament adopted its position on 20 October 2026 (as reported: an exemption for EU micro and small enterprises until 2035). The Council's negotiating mandate of 21 October 2026 covers packaging only: EU-established producers placing less than 1 tonne of packaging per year in another member state would not need a representative there until 1 January 2032. It does not cover batteries. Trilogue negotiations follow. None of this is law yet, and none of it helps sellers established outside the EU โ until a final text is adopted, the current duty applies.
